On December 1, 1962, the Permanent War Council established by Rómulo Betancourt sentenced Fabricio Ojeda to 18 years in prison.

Along with him, of the 138 defendants, 78 were sentenced to 16 years and eight months, 31 were acquitted and 10 were dismissed.

Among the defendants was the guerrilla fighter José Manuel Saher Eljuri “Chema” (1942-1967), to whom the same sentence as Fabricio Ojeda was applied to be carried out at the San Carlos Barracks.

They were also sentenced to 18 years in prison: Clodovaldo José Russián Uzcátegui, Rufo Antonio Meneses, Pedro Rachid Ramos, Neptalí Barbera, Gregorio Antonio Lunar Márquez, Eduardo César Ortiz Bucarán, Isidro Miral Farías, Lubén Petkoff Malek, Jesús Antonio Pardo and Oscar Porfirio Guaitero Díaz.

As soon as the reading of the sentence was completed, the five lawyers who made up the defendants' defense committee appealed against it.

Dr. Jaime José Escalona, magistrate rapporteur of the Permanent War Council, saved his vote by recording a voluminous file that rejects the motivational, expository and decision-making part of the judgments.
