Supreme Court suspends container transit charges and inspections at customs offices in La Guaira and Carabobo

The Constitutional Chamber of the Supreme Court of Justice (TSJ) suspended in a precautionary manner the charges applied to the transit of containers on customs and land roads, as well as health inspections at ports and airports issued by the regional executives of La Guaira and Carabobo.
The decisions, contained in judgments No. 0931 and No. 0932 drafted by Judge Tania D'Amelio Cardiet, declare the jurisdiction of the court and admit two requests for annulment due to unconstitutionality.
In decision No. 0931, the Chamber granted the precautionary suspension erga omnes and with ex nunc effect of Executive Decree No. 037-2020 of the Government of La Guaira, an instrument that empowered a state company to receive a social contribution for the surface use of roads and the transport of containers in that customs and port jurisdiction.
In addition, as reported by the Venezuelan News Agency (AVN), it froze Article 8 of Decree No. 041-2020, which ordered the application of biosafety and inspection protocols to containers, aircraft, ports and regional airports.
At the same time, through judgment No. 0932, the highest court paralyzed the application of articles 10 and 11 of Decree No. 335 of the Government of Carabobo, which established various regional regulations and commercial agreements in the above-mentioned area.
Files 26-1283 and 26-1285 were referred to the Court of Substantiation to continue the legal procedure. The ruling orders summoning the governors, attorneys and representatives of the legislative councils of both states, in addition to notifying the Attorney General of the Republic, the Ombudsman and the Attorney General of the Republic.
