Argentine Court of Appeals issues second precautionary measure against Milei's decree

The Argentine National Chamber of Labor Appeals issued a second precautionary measure this Thursday to suspend the application of labor reforms included in the decree promoted by the government of the extreme right Javier Milei, a few days after taking power.
The court's issuance proposed “to provide for the precautionary suspension of the effects of Urgent and Necessary Decree (DNU) 70/2023 (B.O. 21/12/2023) with regard to the operation of the provisions contained in its Title IV (WORK -arts. 53 to 97-) until a resolution is issued on the merits”, quotes TELESUR on its web portal.
The Chamber thus responded affirmatively to an appeal filed by the Confederation of Workers of Argentina (CTA).
In this regard, the CTA, faced with the first precautionary measure issued by the Argentine National Chamber of Labor Appeals, said that the provision collectively suspends the effects of the regulations contained in Chapter IV of the Decree of Necessity and Urgency 70/23 (labor reform).
“He did so in response to a request from the CGT that had been dismissed in the first instance because, the intervening judge, the DNU had not yet entered into force. Faced with the appeal of the CGT, the fair's judicial authorities accepted the request to enable them to act during the month of January and granted the precautionary measure,” said the CTA.
The decree, in force since December 28, establishes the reduction of contributions and retirement contributions, and also extends probationary periods in companies, reduces leave for pregnancy and establishes changes in labor judgments.
Javier Milei's decree includes economic measures that prioritize private companies over public ones.
The National Coordination of Industrial Workers (CNTI) stressed that it opposes “the plan to definance and privatize public sector companies that the government of Javier Milei and his ally Mauricio Macri seeks to impose.”
“We stand in solidarity with all the workers who today are the target of a campaign that has used disinformation and sensationalism to misrepresent the role and importance of Argentine public companies,” said the CNTI.
