Bogotá High Court grants provisional release to former President Álvaro Uribe

A Colombian court of justice ordered the release of former President Álvaro Uribe, who had been sentenced to 12 years of house imprisonment for the crime of procedural fraud. The court decision rescinds the first instance ruling that had ordered the deprivation of liberty of the former president.

The resolution, issued by Judge Leonel Rogeles Moreno, provides that the corresponding court “immediately issues the release ballot in favor of the guardian”. The measure is taken while the criminal decision chamber of the Court of Appeal defines the appeal filed against the initial conviction.

The court ruling argues that the analysis that led to Uribe's immediate capture “did not meet criteria of necessity, appropriateness, proportionality and reasonableness.” According to the resolution, the prison decision was based on “arguments, mostly generic, ambiguous, subjective, alien to procedural reality and/or not proven, to the detriment of the fundamental prerogative of individual freedom,” international press reported.
