Colombia: Bogotá Superior Court denied Uribe's defense request to stop house arrest

The Superior Court of Bogotá denied the provisional measure requested by the Defense of the father of Colombian paramilitarism, Álvaro Uribe, to suspend the house arrest ordered against him, keeping the judicial decision in force while the guardianship presented is being analyzed.

The Colombian Court Chamber determined that there are no sufficient reasons to suspend the house arrest order imposed by Judge Sandra Liliana Heredia, who sentenced Uribe to 12 years in prison for the crimes of bribery in criminal proceedings and procedural fraud.

The defense of the former president argued that the measure violates his human rights and the presumption of innocence, requesting a precautionary measure to immediately stop the arrest.

“There are no reasons why, at this stage of the guardianship process, the order issued by the acting judicial authority should be suspended; especially since, except for the actor's disagreement with the judicial decision, for the time being, no irregularity has been noticed that is of the significance necessary to estimate a relevant effect on the fundamental rights of the pre-named,” the ruling detailed.
