President of the Real Estate Chamber: Housing Leasing Act boosts market dynamism

The president of the Venezuelan Real Estate Chamber (CIV), Pablo González, said yesterday that the revision and reform of the real estate legal framework in Venezuela represents a decisive step for the recovery of owners' trust and the dynamism of the market, where the central axis of this progress is the restoration and rescue of private property.
In that regard, he reaffirmed that guaranteeing private property is the first step in recovering market dynamism. “When you have private property (...) you have a rental guarantee, and if you have a rental guarantee, then you already have an incentive to get into the subject,” he said during an interview broadcast by Globovision.
González explained the pillars that are reflected in the new Law on the Special Regime for the Lease of Real Estate Intended for Housing, recently approved by the National Assembly (AN), such as the autonomy of the will, since the agreement between the parties who “make law through a contract” prevails.
He also mentioned transparent deposits and guarantees, these are the defined times for security deposits at the time of delivering the apartment, which can be canceled through a bond or insurance policy; indexed contracts: legal possibility of setting fees in currencies and the resolution of conflicts, it is possible to address differences through arbitration.
He clarified that the entry into force of the regulation will contemplate two regimes: contracts concluded prior to their publication in the Official Gazette will continue to be regulated by the law of 2011, while new tenancy relationships will be strictly governed by the new legal framework.
“What he does is tell the owner: 'We have conditions that are perfectible, conditions that need to be improved. ' But without a doubt, we have an important step forward that allows us to say: 'We are going to build trust, 'he said.
The union spokesman highlighted that the organized private sector, under the leadership of FEDECÁMARAS, has actively participated in working groups to consolidate representative proposals in the face of the country's emergencies.
“The first thing that is required in the country is a vision and in order to have a vision, we need to have a concept of unity (...) That concept of unity is now represented in Fedecamaras through its board of directors,” he said.
He also highlighted that the CIV visualizes the rescue of private property as a catalyst for connecting real estate developers with investors through the capital market, which makes it possible to attract resources for the construction of new housing solutions. González called for the recovery of trust between citizens.
On the other hand, referring to the solidarity shown in the state of La Guaira after the earthquakes, he stressed that this is “an impulse that cannot be lost”.
“This situation forces us to think about the country we want (...) how we build ourselves as a society, forgetting a little about politics. That's where we have to call on Venezuelan capitals to enter; they are Venezuelan capitals called to rebuild the country,” he emphasized.
