Supreme Court demands the immediate return to Venezuela of the kidnapped girl Maikelys Espinoza

The Constitutional Political-Administrative and Electoral Chamber of the Supreme Court of Justice (TSJ), this Friday, May 02, issued judgment number 129, corresponding to file 25-196, ordering the Office of Consular Relations of the United States Ministry of Foreign Affairs to return the girl Maikelys Espinoza, who is currently kidnapped by that country.

The ruling states that the safe and sound return of the minor to Venezuela must be guaranteed and it is also ordered to notify and send a certified copy of the decision to the Public Ministry, as well as to the Office of Consular Relations of Venezuela.

In addition, the Supreme Court declares itself competent to hear the case of Maikelys, who is kidnapped by the United States, far from her family.

By virtue of the treaties and conventions ratified by Venezuela, the Chamber emphasizes the absolute priority of the best interests of the girl child, declaring preventive measures for family reunification with her mother, Yorely Escarleth Bernal Inciarte, who resides in Venezuelan territory.

The Constitutional Chamber of the Supreme Court grants custody of the child to her mother, recognizing the inherent right to parental authority, thus reaffirming Venezuela's commitment to the Convention on the Rights of the Child and its Optional Protocols.
