TSJ imposed a fine of 10 million dollars on Tik Tok

The Constitutional Chamber of the Supreme Court of Justice (TSJ), through a ruling issued on December 30, imposed a fine of 10 million American dollars on the social network Tik Tok.

In the judgment read by the president of this instance of the Supreme Court, Judge Tania D'Amelio, it is explained that the decision was taken due to the negligence of Tik Tok to limit the proliferation of content that encourages younger people to harm themselves, through so-called viral challenges.

In this regard, he stressed that the money must be paid to the National Telecommunications Commission (CONATEL) within a maximum period of eight days after the publication of the judgment.

With these resources, which the ruling dictates, a fund will be created, which will be administered by CONATEL, to serve the victims of the viral challenges of Tik Tok. “This fund will be used to compensate for mental, emotional and physical harm to users, and especially if they are boys, girls and adolescents,” the text states.

In the same way, the decision indicates that if the fine is not paid in the corresponding time, “the Constitutional Chamber of the Supreme Court may take whatever measures it deems pertinent to this case”.

In addition, the decision of the country's highest court requires Tik Tok to set up an office within our territory, so that the application of technological tools can be monitored and controlled in accordance with our legal system.

“All this in order to improve the security of users. In addition to preserving their physical, psychological and emotional integrity”, reads the ruling.

On the other hand, the Supreme Court ordered the formation of a technical panel with the families of those aggrieved by the viral challenges “in order to quantify the damages caused by the facts established in the present case and which include tragic and deadly consequences for the victims.”

It is important to remember that the decision of the Supreme Court was taken after families and State institutions went to this instance to request that it intervene in the face of the appearance of viral challenges on the aforementioned social network, which have left fatalities in the country.
